The Transparency Law, enacted in 2009, has among its functions another tool for controlling public accounts and how parliament uses taxpayers' money. However, more than the existence of the legislation, it is important to verify its application and its real effectiveness.


How did the Transparency Law innovate?
Complementary Law 131/2009 introduced several changes to the Fiscal Responsibility Law (LRF) and began to require the provision, in real time, of detailed information on the budgetary and financial execution of the Union, States, Federal District and Municipalities. This requirement, which seeks to enforce the Publicity principle enshrined in the Constitution, was only made possible thanks to the existence of the Internet and the expansion of its access.

The Access to Information Act: another step in the same direction
In 2011, Brazilian democracy took another step towards transparency with the approval and enactment of Law No. 12,527, known as the Access to Information Law (LAI). Unlike the Transparency Law, which focuses on public accounts, the LAI regulates broad access to information and the procedures that must be followed by all government agencies in cases where citizens request access to data.


The LAI also requires greater control over the use of resources by non-profit private entities that receive, to carry out actions of public interest, public funds directly from the budget, or through social assistance, management contracts, partnership terms, agreements, arrangements, adjustments or other similar means.
