According to Bellamy, the existing regulations in this field are still weak, both internationally and nationally, and the government still does not have a clear presence in decisions about the adoption of ARTs, as well as their application in women's bodies. At the state level, regulations are limited to health issues, and are the responsibility of the National Health Surveillance Agency (Anvisa) , which allows for self-regulation by the medical profession and the market, which can lead to contradictions and conflicts of interest.


“One of Anvisa’s responsibilities is to verify compliance with health measures during the handling of gametes by the germ cell and tissue banks (GTCs) of assisted reproduction clinics. The agency is also responsible for collecting information on the number of frozen embryos in Brazil, as per the table below. However, information regarding the freezing of female gametes is not yet required or monitored by Anvisa.”
